Terms of Service

These terms form a contract between Sawyer Krebs, sole proprietor, trading as PestDesk ("PestDesk", "we") and the business that subscribes ("you"). By using the platform, the embed widget or a client portal login, you accept these terms. You confirm you are authorised to bind your business and that you hold any pest control licences required where you operate.

A hosted AI front desk widget for your website, a client portal showing the leads it captures, instant alerts, and configuration of your branding, promised response time, pest list and urgency rules. We may improve or change features, and will give reasonable notice before removing something you rely on.

Plans are billed monthly in Canadian dollars and start the day your widget goes live: Trial at $50/month for up to 50 captured leads, Growth at $99/month for up to 150 captured leads, and Empire at $200/month with unlimited captured leads. Larger operations and multi-branch groups are quoted individually.

A "captured lead" is one saved conversation containing a name, phone number, postal or ZIP code and a pest issue. If you exceed your plan's limit we will contact you to upgrade; capture is not cut off mid-month without notice. Applicable GST or provincial sales tax is added where required. Fees are non-refundable except where the law requires otherwise.

Subscriptions renew monthly until cancelled. You may cancel any time by emailing work.sawyerkrebs@gmail.com; service continues to the end of the paid month. We may suspend an account for non-payment after notice, or immediately for activity that breaks the law or our Acceptable Use policy. On closure we export your leads on request and delete them within 30 days.

You own the leads captured through your widget. We process them on your instructions to provide the service, as described in our Privacy Policy, and do not sell them or use them for our own marketing. You are responsible for telling your website visitors how you will use their information, for honouring opt-outs and deletion requests, and for following applicable privacy, anti-spam and telemarketing law (including PIPEDA, provincial privacy law, CASL, CAN-SPAM, the TCPA and state privacy laws) when you contact a lead.

The assistant triages enquiries; it is not a licensed applicator and gives no treatment, chemical, pricing, legal or medical advice. Automated urgency labels are a best effort and may be wrong. You remain responsible for assessing each job, for the accuracy of the response time you advertise, and for any promise you make to a customer.

We aim for high availability but do not guarantee uninterrupted service, and maintenance or third-party outages can interrupt it. Support is by email at work.sawyerkrebs@gmail.com, normally answered within one business day.

You will not resell the platform without written permission, reverse engineer it, load it with fake or scraped contact data, use it to contact people who have opted out, or place the widget on a site unrelated to your licensed pest control business. See our Acceptable Use policy.

The service is provided "as is" without warranties beyond those that cannot lawfully be excluded. To the fullest extent permitted by law, our total liability for any claim is limited to the fees you paid in the three months before the claim, and we are not liable for lost profits, lost leads, or indirect or consequential loss. Nothing here limits liability for fraud, or for anything that cannot be limited under consumer protection law.

You will indemnify us against claims arising from your use of lead data, your messages to customers, or your breach of these terms or of applicable law.

We may update these terms with at least 30 days' email notice; continuing to use the service after that date accepts the update. These terms are governed by the laws of Alberta, Canada, and the courts of Alberta have jurisdiction, without removing any mandatory consumer rights you have where you live.
